1. About Khala Drive

Khala Drive is an online directory that helps customers in Kenya find vehicles for hire and contact the owners directly. We are not a car hire company, we do not own or operate the vehicles listed, and we are not a party to any agreement between a customer and a provider. Khala Drive operates online from Kenya.

2. Accounts

• You must be at least 18 years old to register as a provider.
• The information you give us must be true and kept up to date.
• You are responsible for keeping your password safe and for everything done through your account.

3. Plans and payments (providers)

• Providers pay a flat subscription to list vehicles. Plans, prices and listing limits are shown on our pricing page and may change from time to time; a change does not affect a period you have already paid for.
• Payments are made by M-Pesa through our payment partner, IntaSend. Each successful payment activates your plan for 30 days.
• When a plan expires, your listings stay live for a 3-day grace period. After that they are paused (not deleted) and hidden from customers until you renew.
• We do not take a commission on bookings. Whatever you agree with a customer stays between you and the customer.
• Subscription payments are for the listing period they cover and are not refundable once a plan has been activated, unless the law requires otherwise or we agree in writing.

4. Provider responsibilities

If you list a vehicle, you confirm that:

• you own the vehicle or are authorised to hire it out, and the listing, photos, prices and availability are accurate;
• you hold every licence, permit and insurance cover that the law requires for hiring out the vehicle (for example from NTSA or your insurer);
• you own the photos you upload, or have permission to use them, and you allow Khala Drive to display them on the site;
• you will reply to customers honestly and promptly and will honour the prices and terms you advertise.

You must not post fake, misleading or duplicate listings, list vehicles you cannot supply, or use Khala Drive for anything illegal, abusive or fraudulent.

5. What is shown publicly

To work as a directory, we publish your business name, location, phone or WhatsApp number, plan badge and your vehicle details and photos on Khala Drive. Your email address and personal name are not shown on listings. See our Privacy Policy for details.

6. Verification

Where a provider shows a Verified badge, it means we have carried out basic checks on that provider. It is not a guarantee of the quality, safety, legality or insurance of any vehicle or service.

7. Customers

If you contact a provider through Khala Drive, you do so at your own risk. Before you pay or drive away, check the vehicle, the provider’s identity, the vehicle documents and the insurance cover in person, and agree the price and terms in writing. Never pay a deposit to someone you have not met or verified. Any agreement is between you and the provider only.

8. Content and intellectual property

The Khala Drive name, logo and site design belong to us. Providers keep ownership of their content but give us a non-exclusive licence to display it on Khala Drive and in search results for as long as the listing is live.

9. Removal and suspension

We may edit, pause or remove a listing, or suspend or close an account, if these terms are broken, if a listing appears to be false or unsafe, or if we receive a credible complaint. You can ask us to close your account at any time by emailing us.

10. Our responsibility

We work hard to keep the site accurate and available, but we provide it “as is”. To the fullest extent the law allows, Khala Drive is not responsible for the conduct of providers or customers, for vehicles, bookings, payments between customers and providers, accidents, losses or disputes, or for interruptions to the site. Nothing in these terms limits any right you have under Kenyan law that cannot be limited.

11. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If you keep using Khala Drive after a change, you accept the updated terms.

12. Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.
